The Legal Process

If you’re here, it’s because a judge has likely given you an Attorney for the Child (AFC). An AFC is necessary in certain cases, like abuse or neglect, but the court may decide to give clients AFCs in other kinds of family cases. 

  • An AFC is specially trained to understand a child client’s ability to make decisions and communicate.
  • An AFC will tailor a plan to your needs and desires. 
  • An AFC at the Children’s Law Center will work with a CLC social worker to represent you, not your parents, or the court.  

Your AFC will:  

  • Listen: Your AFC will meet and listen to you. 
  • Explain: Your AFC will help you understand what’s happening and answer any questions. 
  • Speak Up for You: Your AFC will tell the judge and others what you want. 
  • Keep Things Private: Your AFC keeps your conversations private.

Can I pick my lawyer?

CLC will assign you an AFC.


When will I meet my AFC? And where?

Usually, you will meet your AFC soon after the case starts.  The meeting usually takes place in the AFC’s office, or sometimes, over video.


What should I expect in our first meeting? 

At the first meeting, your AFC will explain what it means to have your own lawyer. You can expect your AFC to ask you some questions that will help them better get to know about you and your family. They will want to understand your position on what you think is best for your family!


What if I don’t want to talk to my AFC? 

Your AFC is here to help you – not judge or talk over you. If you’re nervous, that’s okay. You’re allowed to take your time.  


Will my AFC tell the judge what I want?  

Yes. And the AFC will only tell the judge what you want them to say.


What if I don’t know what I want? 

If you’re unsure, your AFC may argue for what they believe is best for you.

Why is a CLC social worker contacting me?

Your AFC will focus on what happens in court. CLC might put you in contact with a social worker who will help with what’s happening outside of it.

Your social worker does not work for the government – they work for you. That means everything you say will be private unless you want it to be shared. A CLC social worker is not a “mandated reporter,” and will follow your wishes. 

Your CLC social worker might help you: 

  • Find a safe place to stay: If you don’t feel safe, they can help find a trusted adult to stay with. 
  • Get support in school: If you’re struggling in school or need special help, they can advocate for you. 
  • Get help with counseling and other services: They can help you find therapy or support groups. 
  • Keep things private: They will only share what you want them to unless there’s immediate danger. 
  • Figure out what you want to happen. 

What do I have to do in Family Court?

You may have to go to court, but not always. Your AFC will tell the judge what you want and fight for you and your voice. 

Who will be in the courtroom? 

A judge, lawyers, and sometimes, social workers. Your parents may be there, but they do not control what your AFC says. 


Do I have a say in what happens to me? 

Yes. Your AFC will make sure of it. The ultimate decision is up to the judge. 


Will my AFC tell the judge what I want? 

Yes. Your AFC and social worker, through getting to know you, will have have come up with a plan that is about what you want. 


Will my AFC make decisions for me? 

No. Your AFC will help you understand your choices. The judge will make the final decision.

Will I have to go back to court? 

Sometimes. If things change, a judge may need to make another decision.

The legal process may be difficult to navigate for parents and children alike.  

Who does CLC represent? Can I also be represented?

CLC’s team represents your child. The AFC cannot represent you. 


How involved will I be? 

Your child’s AFC may speak with you, but their job is to advocate for what your child wants.
